Terms and Conditions

1. Agreement to these terms

These Terms and Conditions (“Terms”) are a legal agreement between you and BariNation Foundation, a Washington nonprofit corporation (“BariNation,” “we,” “us,” or “our”). They apply to barination.org and the content and features we make available through it, including the Bari AI companion (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms and our Privacy and Consumer Health Data Policy and AI Policy. If you do not agree, do not use the Services.

2. Education and support, not medical care

Do not delay or disregard professional medical advice because of anything on the Services. Treatment options, risks, benefits, eligibility, and outcomes differ from person to person. Discuss health decisions with an appropriately licensed clinician.

If you may be experiencing a medical emergency, call 911 or your local emergency number. If you are in the United States or Canada and are experiencing a suicide or mental-health crisis, call or text 988.

3. AI companion

Bari uses generative artificial intelligence. AI output may be incomplete, inaccurate, outdated, or inappropriate for your circumstances. Review linked sources and verify important information with a qualified professional. Do not enter names, dates of birth, medical record numbers, contact details, full medication lists, or other information that could identify you or another person.

Bari is not a human, clinician, crisis counselor, or representative authorized to make commitments for BariNation. Our AI Policy explains how the feature works and its boundaries.

4. Eligibility and minors

The interactive portions of the Services are intended for adults. If you are under 18, use them only with the involvement of a parent or legal guardian. Children under 13 may not use the AI companion or submit personal information through the Services.

5. Acceptable use

You may use the Services only for lawful, personal, and noncommercial purposes. You agree not to:

• use the Services to harm, threaten, harass, exploit, or impersonate anyone;
• submit another person’s private, confidential, or health information without authority;
• attempt to bypass security controls, probe for vulnerabilities, disrupt the Services, or introduce malicious code;
• scrape, copy, train a model on, or commercially exploit the Services or their content except with our written permission or as applicable law allows;
• misrepresent AI output as individualized medical advice or as a statement from a BariNation clinician; or
• use the Services in a way that violates law or another person’s rights.

We may limit or block access when reasonably necessary to protect users, BariNation, or the Services.

6. Content and intellectual property

The Services and their original text, graphics, branding, software, audio, video, and other materials are owned by BariNation or used with permission and are protected by intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for personal, noncommercial purposes.

Guest statements, member stories, and linked materials reflect their respective authors or speakers and do not necessarily represent BariNation’s position. You retain ownership of content you send to us, but you grant us the rights reasonably necessary to receive, process, and respond to it. Any separate release or contributor agreement controls content submitted for publication.

7. Donations and external services

Donations are processed by Givecloud and its payment partners, not directly on this website. Their terms and privacy practices also apply. Tax deductibility depends on applicable law and your circumstances; keep your receipt and consult a tax adviser if needed. If you believe a donation was made in error, contact us promptly. Refund requests are handled as required by law and any applicable processor terms.

The community, newsletter, podcast platforms, and other third-party sites are operated by their respective providers. We do not control and are not responsible for their content, availability, security, or policies. A link does not necessarily mean endorsement.

8. Availability and changes

We may change, suspend, or discontinue any part of the Services. We aim to provide useful, accurate information but do not promise that the Services will always be available, secure, error-free, complete, or current. We may update these Terms by posting a revised version and changing the “Last updated” date. Material changes will apply prospectively to the extent required by law.

9. Disclaimers

To the fullest extent allowed by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

10. Limitation of liability

To the fullest extent allowed by law, BariNation and its directors, officers, employees, volunteers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities arising from or related to the Services. These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.

11. Governing law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules, except where applicable law requires otherwise. Any dispute that is not resolved informally will be brought in a court with lawful jurisdiction in Washington, unless applicable consumer law gives you the right to bring it elsewhere.

12. General terms

If part of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies linked above and any feature-specific terms, are the entire agreement about the Services. You may not transfer your rights under these Terms without our consent.
